1. Agreement to Terms

By creating an account or using Ask Nancy ("the Service"), you agree to be bound by these Terms of Use. If you do not agree, do not use the Service. We may update these terms at any time. Continued use after changes constitutes acceptance of the updated terms.

2. Important Disclaimer — Not Medical or Therapeutic Advice

Ask Nancy is an educational wellness platform, not a healthcare provider. The Service provides guided exercises, AI-generated responses, and educational content informed by published research. It is not a substitute for professional therapy, counseling, psychiatry, medical treatment, or crisis intervention.

Nancy is an AI, not a licensed professional. Nancy does not diagnose conditions, prescribe treatments, or provide medical advice. AI responses are generated by language models and may contain inaccuracies. You should not rely on any information from the Service as a basis for making medical, legal, financial, or personal safety decisions.

If you are in crisis, contact a licensed professional immediately or reach out to your local crisis helpline or emergency services.

By using the Service, you acknowledge that you understand and accept these limitations.

3. Eligibility

You must be at least 18 years of age to use Ask Nancy. By creating an account, you represent and warrant that you are 18 or older. The Service contains content related to intimacy, sexuality, and emotional wellness that is intended exclusively for adults.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

4. Assumption of Risk

Wellness and self-improvement involve inherent risks. Exercises involving emotional processing, body awareness, and relationship dynamics may surface difficult emotions or memories. By using the Service, you acknowledge and accept that:

  • Emotional exercises may temporarily increase distress before improvement occurs
  • Relationship exercises done with a partner require mutual consent and may not improve all relationships
  • Body awareness exercises are educational, not medical treatments, and are not appropriate for all individuals
  • AI-generated content may not be appropriate for your specific circumstances
  • You should discontinue any exercise that causes significant distress and consult a professional

You voluntarily assume all risks associated with using the Service.

5. Subscriptions & Payment

Paid plans are billed on a recurring basis (monthly, quarterly, or yearly). Prices are listed on our pricing page. You can cancel anytime from your account settings. Cancellation takes effect at the end of your current billing period. No partial refunds are issued for unused time within a billing period.

Price changes: We may change subscription prices from time to time. For any price increase to an existing subscription, we will give you at least 30 days advance notice by email (and, where required by law, will obtain your affirmative consent before charging the new price). If you do not accept the new price, you may cancel before the change takes effect and will continue to be charged the existing price through the end of your current billing period.

Free trials and promotions: If we offer a free trial or promotional rate, we will disclose the specific terms at signup (length, auto-conversion price, cancellation window). Unless stated otherwise, trials convert to a paid subscription at the stated price unless you cancel before the trial ends.

Apple App Store purchases: Payment will be charged to your Apple ID account at confirmation of purchase. Subscription automatically renews unless it is canceled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period. You can manage and cancel your subscription in your device's Settings > Apple ID > Subscriptions.

Google Play purchases: Payment will be charged to your Google account at confirmation of purchase. Subscription automatically renews unless canceled. You can manage and cancel your subscription in Google Play Store > Subscriptions.

6. Content & Intellectual Property

All course content, exercises, AI-generated materials, branding, and software are owned by Ask Nancy or its licensors. Your subscription grants you a personal, non-transferable, non-exclusive license to access the content for your own private use. You may not reproduce, redistribute, resell, publicly display, or create derivative works from our content without prior written consent.

Content you create within the Service (journal entries, chat messages, notes) remains yours. By using the Service, you grant us a limited license to process this content for the purpose of delivering and improving the Service.

7. AI-Generated Content

Portions of the Service use artificial intelligence to generate personalized responses, exercise plans, and insights. AI-generated content:

  • Is not reviewed by a licensed professional before delivery
  • May contain errors, inaccuracies, or responses that are not appropriate for your situation
  • Should not be treated as professional advice of any kind
  • May vary in quality and relevance

We make reasonable efforts to ensure AI responses are safe and appropriate but cannot guarantee accuracy or suitability for any individual.

8. Prohibited Conduct

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to manipulate, circumvent, or exploit the AI system
  • Share account credentials with others
  • Use automated tools to access the Service (bots, scrapers)
  • Reverse engineer or decompile any part of the Service
  • Harass, abuse, or send harmful content through any Service feature

We reserve the right to suspend or terminate accounts that violate these terms without refund.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ASK NANCY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES, ARISING FROM:

  • Your use of or inability to use the Service
  • Any content obtained from the Service, including AI-generated content
  • Any emotional, psychological, or relational outcomes resulting from exercises or advice
  • Unauthorized access to your data
  • Any third-party conduct on the Service

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

10. Indemnification

You agree to indemnify, defend, and hold harmless Ask Nancy and its officers, directors, employees, contractors, and agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of another person or entity.

11. Dispute Resolution & Arbitration

Informal Resolution First: Before filing any formal dispute, you agree to contact us through our website and attempt to resolve the dispute informally for at least 30 days.

Binding Arbitration: Any dispute not resolved informally shall be resolved by binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. Arbitration will be conducted in English, and the arbitrator's decision will be final and enforceable in any court of competent jurisdiction.

Class Action Waiver: You agree that any dispute resolution will be conducted on an individual basis only, and not as a class action, consolidated action, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against Ask Nancy.

Small Claims Exception: Either party may bring an individual action in small claims court if the claim qualifies.

Your Right to Opt Out of Arbitration: You may opt out of this Arbitration and Class Action Waiver provision by sending written notice to trackyourbudgetph@gmail.com within 30 days of first accepting these Terms. Your notice must include your full name, the email address associated with your account, and a clear statement that you wish to opt out of arbitration. Opting out will not affect any other provisions of these Terms, and will not be used against you in any way by us.

30-Day Right to Reject Future Changes: If we materially change this Section 11 (Dispute Resolution & Arbitration) in the future, you may reject the change by sending written notice to the same address within 30 days of the change taking effect. In that case, the most recent version of this Section that you accepted will continue to govern any disputes between us.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict of law principles. Any litigation not subject to arbitration shall be brought exclusively in the state or federal courts located in San Francisco, California.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. Sections 2, 4, 7, 9, 10, 11, and 12 survive termination.
